Rights of workers on ‘Annual Leave’ given by UAE law

Workers working in a private sector company in the UAE may have some doubts about how to take their Annual Leave. As a solution to such people’s doubts, here you can know the full rights of the workers working in the private sector under the UAE Labor Law.

The UAE Ministry of Human Resources and Immigration (MOHRE) shared on its official social media page about their annual leave entitlement for workers. According to the record, UAE labor law allows an employee to take annual leave even if he has not completed one year with the company.

That is, once an employed employee completes his probationary period of six months of service, he can take leave. According to UAE law, he can take 12 days of annual leave every six months at the rate of two days a month. This account is applicable till he completes one year.

However, the employee shall be entitled to annual leave of 30 days per annum if he has completed one year of service. Perhaps, if the employee leaves the job before availing the annual leave, he is also entitled to the annual leave salary based on his years of service.
Already, the new labor law, which came into effect on February 2 last year, has revamped various aspects of the labor relationship between employers and employees. In particular, Section 29 of the Act lays down detailed rules on annual leave to which an employee is entitled.

According States Act Article:

  1. All employees can take annual leave with pay of 30 days per year for every year of service.
  2. Employees whose period of service is more than six months and less than one year are allowed to take annual leave at the rate of two days per month.
  3. In case the employee leaves the company before availing his annual leave, he is entitled to the previous years annual leave pay.
  4. Part-time employees may also take annual leave according to the actual working hours spent by the worker in the service of the employer. But, for that, working hours should be determined in the employment contract.
  5. According to the agreement with the employee, the employer can fix the dates of leave or provide annual leave in rotation among the employees for smooth progress of work.
  6. An employee is entitled to be paid annual leave.
  7. An employee may, with the consent of the employer, carry over his annual leave salary balance or days thereof to the next year.
  8. The employer cannot prevent the employee from using annual leave for more than two years, unless, as per the regulations, the employee wishes to carry over the leave to the next year or to receive pay in lieu of leave.
