Federal Decree-Law Introduces Penalties for Violations, Enhances Regulatory Framework

UAE introduces major labor law amendments with fines up to Dh1 million

On Monday, the UAE Government announced significant changes to its employment regulations through the issuance of a Federal Decree-Law. These amendments introduce a new range of fines, which could reach up to Dh1 million, aimed at addressing various breaches relating to employment practices. The updates are designed to improve the legal framework governing labor relations, promote compliance, and protect the rights of all parties involved.

Key Provisions of the New Act

Fine for Violation

Under the new provisions, employers will be subject to substantial fines for a number of violations:

Employment Without a Work Permit: Employers who hire workers without valid work permits or do not employ individuals brought into the country will face fines. This measure aims to ensure that all employment is legally sanctioned and that workers are given proper roles.

Closure of Business Without Settling Rights of Workers: Employers who close their business without settling all outstanding rights and entitlements of workers will be punished. This provision ensures that employees are fairly compensated even if their employer shuts down operations.

Fraudulent Labor Practices: Employers who engage in fraudulent activities, such as creating fictitious job positions or engaging in deceptive Emiratisation practices, will be fined. This clause targets deceptive practices that undermine the integrity of the labor market.

Employing Minors: Any employment of minors contrary to legal norms will be met with financial penalties. This regulation is intended to protect minor individuals from exploitation and ensure compliance with child labor laws.

Evading Labor Market Laws: Employers who attempt to circumvent labor laws or regulations, including engaging in fictitious employment schemes, will face fines. This provision aims to prevent abuse of the system and maintain fair labor practices.

Fines for these violations will be scaled based on the number of workers involved in fictitious employment schemes. This approach ensures that the punishment is proportionate to the degree of the violation.

Settlement and Enforcement

Settlement Authority: The Ministry of Human Resources and Emiratisation now has the authority to facilitate settlement. Employers can resolve disputes by paying 50 percent of the minimum fine amount and paying back any financial incentives obtained through fraudulent employment practices.

Criminal Proceedings: Criminal proceedings relating to fictitious employment or fake Emiratisation may only be initiated at the request of the Minister of Human Resources and Emiratisation or their authorized representative. This ensures that legal actions are taken based on official recommendations.

Dispute Resolution and Legal Procedures

Court of First Instance: Disputes between employers and employees regarding decisions taken by the Ministry should be referred to the Court of First Instance. This change is designed to streamline the dispute resolution process and ensure cases are handled at the appropriate judicial level.

Referral of Cases: As of the date of implementation, the Court of Appeal refers all petitions, disputes and complaints relating to the regulation of labor relations to the Court of First Instance. This adjustment aims to improve the efficiency of legal processes.

Time Limit for Claims: Claims filed more than two years after the termination of an employment relationship will be dismissed. This provision sets a clear deadline for filing claims, helping to handle and resolve disputes in a timely manner.

The new Federal Decree-Law is part of the UAE’s broader efforts to modernize and strengthen its legislative and legal framework. By introducing these amendments, the government aims to:
